The short version: be cool, don't break the law, our products help your skin but aren't medical devices, and any legal disputes will go through arbitration in Maryland.
By using our Site, you agree to the terms below.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of versacare.co and any related services, products, and integrated platforms (collectively, the "Service") operated by Versa Care LLC. By accessing or using the Service, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 (or the age of majority where you live) and able to form a binding contract.
3. Your account
If you create an account, you're responsible for the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Orders, prices, and payment
Prices are in U.S. dollars unless otherwise stated. We reserve the right to refuse, limit, or cancel any order — including suspected fraud or pricing errors. Payment is due at checkout via the methods we accept. By ordering, you authorize us (and our payment processor) to charge the amount shown.
5. Shipping & returns
We ship to addresses we support at the time of your order. Delivery times are estimates and may be affected by carrier delays. Returns and refunds follow our published Refund Policy, which is part of these Terms.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt unauthorized access to any part of the Service.
- Interfere with the operation of the Service (abusive scraping, denial-of-service, malware).
- Reverse engineer or extract source code.
- Misrepresent your identity or impersonate another person.
7. Third-party platforms
We integrate with third-party platforms — TikTok, Amazon, Meta, Google, Shopify — to fulfill orders, deliver advertising, and run our business. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for their content, practices, or availability.
8. Intellectual property
All content on the Service — including the Alpha Sponge brand, logos, product designs, photographs, text, and software — is owned by Versa Care LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent.
9. User content
If you submit content to the Service (reviews, photos, social posts mentioning our brand), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with the Service and our marketing. You confirm you own or have permission to share what you submit.
10. Disclaimer of warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind — express or implied — including fitness for a particular purpose, merchantability, non-infringement, or uninterrupted availability.
Important: our products are personal-care items, not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease. If you have a skin condition, consult a healthcare professional.
11. Limitation of liability
To the maximum extent permitted by law, Versa Care LLC and its officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold Versa Care LLC harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.
13. Termination
We may suspend or terminate your access at any time, with or without notice, if we believe you've violated these Terms or for any reason. You may stop using the Service at any time.
14. Governing law & disputes
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms will be resolved by binding arbitration in Maryland, except that either party may bring an action in small-claims court for qualifying disputes. You waive any right to participate in a class action.
15. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page indicates the last revision. Continued use after changes are posted constitutes acceptance of the new Terms.
